A Detroit police officer who shot and killed 7-year-old Aiyana Stanley–Jones while filming A&E’s The First 48 will not be retried. Officer Joseph Weekley was originally charged with involuntary manslaughter and careless discharge of a firearm after the May 16, 2010 botched police raid at Aiyana’s home.  The Detroit Police Department’s Special Response Team raided Aiyana’s home in search  of a murder suspect. Weekley came through the home’s door first and claims to have poor vision after another officer threw a flash-bang grenade inside. Weekley shot and killed Aiyana, who was asleep on the couch with her grandmother.

Weekley alleged Aiyana’s grandmother Mertilla Jones grabbed his MP5 submachine gun, and wasn’t aware he shot the little girl.  Mertilla maintained she never touched his gun and reached out for her granddaughter. Later on, tests proved Mertilla never made contact with Weekley’s gun.  Weekly’s first trial in 2013 lead to a mistrial. The following year, Wayne County Circuit Court Judge Cynthia Gray Hathaway dismissed the manslaughter charges against him due to a defense motion. Weekley went back to court once again with the jury being deadlocked on whether or not he should be convicted in the lesser charge, resulting in yet another mistrial. According to The Huffington PostWayne County Prosecutor Kym Worthy is moving to dismiss the case against Weekley. In a released statement Kym remarked:

Today we personally informed the family of Aiyana Stanley–Jones that we have made a decision that we would not be going to trial for a third time in the Joseph Weekley case.

A trigger happy police officer who lied about killing a sleeping child gets off?? Unreal.
