A review of surveillance video shows NFL quarterback Michael Vick driving away from his birthday party at a Virginia Beach restaurant last Friday just three minutes before someone fired off two shots.

Vick’s attorney, Larry Woodward, had told reporters the Newport News native left about thirty minutes before the shooting.

WAVY.com’s Mary Kay Mallonee watched the video that surveillance cameras captured outside Guadalajara’s restaurant in Town Center. The time-stamp on the video clearly shows Vick pulling away from the restaurant at 2:07 a.m., and then at 2:10 a.m. all the party-goers standing on the sidewalk duck and run as they hear the shots fired.

The shooting victim is reportedly one of the co-defendants in Michael Vick’s federal dogfighting trial, Quanis Phillips. The two men are on strict probation and are forbidden from associating with other felons.

Japhari Jones promoted Vick’s birthday bash and said Vick and his brother Marcus were nowhere near the shooting. “It didn’t have anything to do with the Vicks, they were long gone before any of that happened,” he said.

Guadalajara spokesman Allen Fabijan said that while the party inside the restaurant went off smoothly without a single problem, the surveillance video that was turned over to police clearly shows a different timeline than offered by Jones or Woodward.

According to the time stamps on the surveillance video:

1:45 a.m.: Guadalajara’s closes.

2:00 a.m.: Vick, who had remained inside the restaurant with some other VIPs, walks out of Guadalajara’s front door. He spends seven minutes shaking hands and signing autographs for fans standing in front of the restaurant.

2:07 a.m.: Vick, in his Mercedes, pulls away from Guadalajara’s.

2:10 a.m.: Shots are fired outside on the street.

Virginia Beach investigators have not arrested anyone, but have said Vick is not a suspect in the shooting and neither is his brother Marcus. Fabijan said at the time of the shooting, Marcus was in the back of the restaurant settling the bill.

Fabijan also said NBA player and Hampton native Allen Iverson was scheduled to hold his own birthday bash at Guadalajara’s this coming weekend, but the restaurant has canceled the party.
